These Terms of Service govern your use of 7aside.com.au and any purchases made through our website. By accessing our website or placing an order, you agree to be bound by these Terms together with our Privacy Policy, Returns & Refunds Policy and any other policies published on our website. If you do not agree with these Terms, please do not use our website.

Eligibility

By accessing or using 7aside.com.au, you confirm that you have the legal capacity to enter into a binding agreement under the laws of your place of residence.

To make a purchase from our website, you must be at least 18 years of age, or have the permission and supervision of a parent or legal guardian who agrees to be bound by these Terms of Service on your behalf.

If you are purchasing products on behalf of a business, organisation or another individual, you confirm that you have the authority to do so and to bind that person or entity to these Terms.

You agree to provide accurate, complete and up-to-date information when creating an account, placing an order or contacting us. Providing false, misleading or fraudulent information may result in the cancellation of your order, suspension of your account or refusal of future service.

You are responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account. If you believe your account has been accessed without your authorisation, you must notify us immediately.

We reserve the right to refuse service, suspend accounts or cancel orders where we reasonably believe a customer has:

·       Breached these Terms of Service.

·       Engaged in fraudulent, unlawful or abusive behaviour.

·       Misused our website, promotions or services.

·       Attempted to interfere with the security or operation of our website.

 

Orders

By placing an order through 7aside.com.au, you are making an offer to purchase products in accordance with these Terms of Service. All orders are subject to acceptance by 7aside and product availability.

An order confirmation email acknowledging receipt of your order does not constitute acceptance of your order. Acceptance occurs only once your order has been processed and dispatched.

We reserve the right, at our sole discretion, to refuse, cancel or limit any order at any time before dispatch, including but not limited to where:

·       A product is unavailable or out of stock.

·       A pricing, product description or website error has occurred.

·       Payment cannot be successfully authorised or verified.

·       We reasonably suspect fraudulent, unlawful or unauthorised activity.

·       An order appears to have been placed for the purpose of resale without our approval.

·       The order breaches these Terms of Service or any other policy published on our website.

If your order is cancelled before dispatch, any payment received will be refunded using the original payment method unless otherwise agreed.

Customers are responsible for ensuring that all information provided at checkout, including billing details, delivery address, email address and contact information, is accurate and complete. 7aside accepts no responsibility for delays, failed deliveries or additional costs resulting from incorrect or incomplete information supplied by the customer.

Orders may be edited through My Account using your order number for up to three (3) hours after purchase. Once this editing period has expired, your order will enter processing and can no longer be modified or cancelled.

We reserve the right to limit quantities purchased per person, household, account or order where we reasonably believe multiple orders have been placed to circumvent promotional limits, purchase restrictions or stock allocations.

Ownership of products passes to you once payment has been received in full and your order has been delivered to the nominated delivery address. However, the risk of loss or damage passes to you upon delivery in accordance with our Shipping Policy.

In the unlikely event that we are unable to fulfil your order due to circumstances beyond our control, we will notify you as soon as reasonably practicable and provide you with the option of a replacement product (where available), store credit or a full refund.

 

Order Changes

We understand that mistakes can happen, which is why we offer customers the ability to edit eligible orders for a limited time after purchase.

Orders may be edited directly through My Account using your order number for up to three (3) hours after the order has been placed. During this period, customers may update eligible order details, including:

·       Delivery address

·       Product size

·       Product colour

·       Product variant

·       Quantity

Once the 3-hour editing window has expired, your order will automatically enter our processing system and can no longer be edited, cancelled or recalled.

While our Customer Support team will always do their best to assist where possible, we cannot guarantee any changes once an order has entered processing or has been dispatched.

If you notice an error with your order, we encourage you to update your order as soon as possible within the permitted editing period or contact us immediately at hello@7aside.com.au.

Please note that submitting a request to change an order after the editing period has expired does not guarantee that the requested changes can be made.

If an incorrect delivery address is provided and the order has already been dispatched, any additional shipping costs associated with redirecting or re-shipping the parcel will be the responsibility of the customer.

Pricing

All prices are shown in Australian Dollars (AUD) unless otherwise stated. Prices and product availability may change without notice. If a pricing error occurs we may cancel the order and provide a full refund.

 

Promotions

From time to time, 7aside may offer promotional campaigns, discount codes, giveaways, competitions, gift-with-purchase offers or other special promotions. Unless otherwise stated, all promotions are subject to these Terms of Service in addition to any specific terms published for the promotion.

Promotional codes and offers:

·       Have no cash value and cannot be exchanged for cash, credit or refunds.

·       May only be used during the advertised promotional period.

·       May only be redeemed once per customer unless otherwise stated.

·       Cannot be applied to previous purchases.

·       Cannot be used after an order has been placed or once an order has been dispatched.

·       May not be combined with any other offer, promotion or discount unless expressly stated.

·       May exclude selected products, collections, gift cards, sale items or limited-edition releases.

·       Are non-transferable and may not be sold, shared or reproduced without our permission.

We reserve the right to amend, suspend or cancel any promotion, discount code or offer at any time without prior notice where reasonably necessary, including where we identify technical errors, fraudulent activity or misuse.

If a discount code is used incorrectly, obtained through unauthorised means, or applied in breach of these Terms, 7aside reserves the right to:

·       Cancel or refuse the order;

·       Remove the promotional discount before dispatch;

·       Recover any improperly applied discount where permitted by law; or

·       Restrict access to future promotions.

Where a product purchased using a promotional discount is later returned for a refund or store credit, the refund or store credit will reflect the amount actually paid for the item after any applicable discounts have been applied. Original shipping charges are non-refundable unless required under the Australian Consumer Law (ACL).

Competitions, giveaways and promotional events may be subject to additional terms and conditions, which will be published alongside the relevant promotion where applicable.

7aside reserves the right to cancel any order where a pricing error, technical malfunction or website error has resulted in an incorrect promotional offer or price being displayed. Where this occurs, customers will be notified as soon as reasonably practicable and offered the option of a full refund or, where available, purchasing the product at the correct price.

 

Products

We make every reasonable effort to display products accurately. Colours may vary depending on your device. Minor manufacturing variations do not constitute defects.

 

Shipping

7aside is committed to processing and dispatching orders as efficiently as possible. Estimated processing and delivery timeframes provided on our website are intended as guides only and are not guaranteed.

While we work closely with our shipping partners to ensure timely delivery, delays may occur due to circumstances beyond our reasonable control, including but not limited to courier delays, public holidays, severe weather, customs processing, industrial action, high shipping volumes or other unforeseen events.

Risk of loss or damage to products passes to you once your order has been delivered to the delivery address or collection point nominated at checkout, except where otherwise required by the Australian Consumer Law (ACL).

Customers are responsible for providing accurate and complete delivery information when placing an order. 7aside is not responsible for delays, failed deliveries or additional costs resulting from incorrect or incomplete information supplied by the customer.

Where a parcel is returned to us due to an incorrect delivery address, failure to collect the parcel, refusal of delivery or any other reason outside our control, additional shipping charges may apply before the order can be re-dispatched.

If you authorise a shipping carrier to leave your parcel unattended ("Authority to Leave"), or the carrier leaves the parcel in accordance with its delivery policies, 7aside is not responsible for any loss, theft or damage that occurs after the parcel has been marked as delivered.

From time to time, orders containing multiple items may be dispatched in separate shipments to ensure the fastest possible delivery. Where applicable, separate tracking information will be provided.

International customers are responsible for any customs duties, import taxes, VAT, brokerage fees or other charges imposed by the destination country unless otherwise stated.

Returns

Returns, exchanges and refunds are governed by our Returns & Refunds Policy.

 

Intellectual Property

User Content

If you submit reviews, photographs or other content, you grant 7aside a worldwide, royalty-free licence to use that content for marketing and promotional purposes. We may remove content that is unlawful, misleading, offensive or infringes another person's rights.

You must not misuse the website, introduce malicious software, scrape content, interfere with website security or use automated systems without permission.

7aside reserves the right to refuse service, decline future orders, suspend customer accounts or restrict access to our website where we reasonably believe a customer has repeatedly abused our returns process, promotional offers, website functionality, engaged in fraudulent or unlawful activity, provided false or misleading information, or otherwise breached these Terms of Service.

Where appropriate, we may also suspend or permanently terminate a customer's access to their online account or other electronic services provided by 7aside. We will exercise these rights reasonably and in accordance with applicable Australian law.

Nothing in this section limits any rights or remedies available to either party under the Australian Consumer Law or any other applicable legislation.

 

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Queensland, Australia, together with all applicable Commonwealth laws of Australia.

By accessing or using 7aside.com.au, creating an account, or purchasing products from us, you agree that these Terms form a legally binding agreement between you and 7aside.

Any dispute, claim or legal proceeding arising out of or relating to these Terms, your use of our website, or any products or services supplied by 7aside will, unless otherwise required by law, be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

Before commencing legal proceedings, both parties agree to make reasonable efforts to resolve any dispute through good-faith communication. We encourage customers to contact our Customer Support team first so we can work towards a fair and timely resolution.

Nothing in these Terms excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law (ACL) or any other applicable legislation that cannot lawfully be excluded.

If any provision of these Terms is found to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision will be deemed severed from these Terms to the extent necessary, without affecting the validity or enforceability of the remaining provisions.

These Terms of Service, together with our Privacy Policy, Returns & Refunds Policy, Shipping Policy, and any other policies published on our website, constitute the entire agreement between you and 7aside regarding your use of our website and supersede any previous agreements, representations or understandings relating to the same subject matter.
